    like PP i also never renew tenancies unless asked.  i also NEVER give a 12 months AST for the first tenancy  - you dont know what a new tenant will be like

    I thought that a 12 month AST was only in effect a 6 month AST as legally it has to have a break cluase in at 6 months?

    But whatever, yes I agree only give a 6 month AST at the begining and then revert to periodic.

    I have never heard that one! For a landlord, enforcing break clauses if they want to remove a tenant after sx months of a 12 month AST is fraught with difficulties and real experts in the field advise against them at all. If you must grant a 12 month AST then do so - and add a rent review clause as well otherwise you won't be able to put up the rent even if you want to.

    Interesting turn of events today; we rang housing benefit as the tenant said he had been refused housing benefit even though he had applied, but the ex girlfriend informed us he had had it.  The truth is he had not had it because he had not answered all the questions on the forms and when he did, it would be due, but we were told that seeing as he is over 8 weeks late with the rent it could be paid direct to us, the landlord.  Does this sound right or another false dawn?!

    If a tenant is over 8 weeks in arrears, then HB will pay the LL direct. Write a letter to HB confirming the rent situation.

    Get a s8 notice, grounds 8, 10 and 11, served on the T now. Each day means another day you are without rent.

    If a landlord wants the tenant to leave, then at least two months notice expiring on a rent day (i.e the day in the month that the periodic tenancy commenced) must be given.

    Hypothetically and just to get confirmation of the correct date which needs to be inserted on the S21, If one of my tenants started a 6 month AST which originally commenced on say 15th November 2007 and it has now been replaced by a statutory periodic tenancy, if I wanted possession asap, what date would I insert on the S21, in "6 (Expiry date) After:  ................ ?"
