Buy in Own Name v Buy in Company Name

    Buy in Own Name v Buy in Company Name

    Hi,

    I want to start buying in my own name, but if I do will this look unprofessional?

     i.e. I will have no company name on my business card. Is that okay or can I still put a company name to look better?

    If I trade as say XYZ Properties, but then buy in my own name will it be questioned by the seller at any point?

    Sorry if these are silly questions but I'm new to BMV.

    Buy in your own name is fine. I have a trading name and buy under my own name for CGT reasons.

    So I can have a trading name, just for the business cards and leaflets, but not trading with the name. Then buy them in my own name.

    Nigel,

    Out of interest, would it not be more beneficial to trade in a co. for CGT reasons? Surely youre going to be knocked with 40% by trading in your personal name? as opposed to 29% had you traded in a company name? (Ive heard that its only really beneficial if youre earning about 60-70k that is). My knowledge on this subject is limited, was just wondering.

    Hi All,

     Very new to this site and have been spending hours (literally) researching a lot of the information on here. This thread caught my eye because I too have been wondering how to buy the property, in my own name or a company one.

     One question though, if I am purchasing in my own name, which I plan to do because I am going for a Buy to Hold strategy, but use a 'Trading Name' to give my self a more credible image - does the trading name have to be registered as a company, or can I simply plug something out of the air and start using it?

    The research is ending and I am ready to make the jump - I feel like I am stood ina cage, very high up with a bungee cord strapped to my ankles!

    Who cares about looking unprofessional if you make money? Seriously, there are many things to consider when it comes to buying in the name of a company, not least:

    1.  if you keep the borrowings in the limited company you can avoid any loss if property prices do crash and you can't repay the borrowings,
    2. keeping the property portfolio in limited company can have large tax benefits, especially if down the line you convert the company to a REIT
    3. a corporation tax self-assessment return is much simpler to fill in than an SA100
    4. potentially, you can issue different types of securities from the limited company to raise capital other than by investing yourself
    5. if you wish to realise part of your investment you can do so by selling some shares without triggering a capital gains tax liability
    6. a company is particularly well suited to collective investment

    I have found a company structure very satisfactory in practice, but I think most SP members avoid incorporation for reasons I have never fully understood.

    steve ... you obviously have no real understanding about tax ... so stop giving stupid advice.  newbies - take professional advice about your tax affairs. ps.  steve - please feel free to elaborate, precisely, on any of the 6 suggestions you make above.  i'm a qualified chartered accountant and would love to hear your rationale for any of your suggestions ...
