Urban Splash - dangers of Off Plan

I read an article in Saturday's Guardian (Money) 18.8.07,  which is almost unbelievable.  See Capital Letters, Tony Levene on page 8.

Someone thought they were buying a two bedroom flat with access to the second bedroom being by "staircase" (according to Urban Splash's lawyers).  When the property was built and the purchaser went to see it, it turned out  that the "staircase" is a actually a ladder, yes a ladder, from the sole bedroom to a "doorless space". Huh?

How on earth can they be allowed to get away with this? Can they?

That's what Kirsty and Phil would call 'potential for adding value'.

    There's a clue in the term 'off-plan'.

I'm sure that if the plans had been inspected, they would have known what they were getting.

Usually states in small print that developer reserves right to change anything he sees fit.
So I would think that the original plans did not show this, they merely used this right to change the plans.

i have mentioned recently elswhere of a development in scotland which had an alleged  2nd bedroom, which turned out to be an area raised about 2 feet in the middle of the lounge !!  this group of purchasers gathered together and won a 3 year legal case against the builders - getting all their money back and costs and interest.

urban splash used to have such a good reputation  ....
