Re: Bahama Bay, Florida, Inside Track

My solicitor is qualified in american law and is based in the uk.  his name is Kevin Burke the company is Bennett law.  this link will take you there.  http://www.bennettlaw.co.uk/kevin-m-burke

Ihave spoke to him today (23 March 09) about getting out of this crap deal we signed up for.  We signed and payed deposit in July 2004 and we are still waiting.  We were the first people that Masebury homes refused to give deposits back to.  With regards getting together, although this sounds good, according to my guy it can slow things down and time is something we do not have.  He is investigating our contract to see if we can just pull out of the deal, cut our losses and run.  loosing £46,000 deposit is better than £127,000 we stand to loose if we complete.

if you have any info, or have had any joy from your situation please let me know at martyncandler@talktalk.net

    thank you.

I too am buying a condo through IT (who have gone bust) and have had much delay - not ready yet.

Thecontract says that the off plan property will be complete in two years from signing.  I am trying to get my deposit back on the grounds of breach of contract

Clauses 11 and 15 are relevant

Brookes and company to Maesbury to court for breach of contract but I do not know the details

John.  We were given the chance to "Flip" from our condo on to a compleated unit, as i am sure hundreds of other people were.

We recieved by email a new Contract of sale for us to sign.  We didnt sign it, and looking at it now i am glad we didnt.  The clauses you speek of have either gone or have been rewritten in much more legal jargon.

i wounder how many people were lured in to this new agreement by the cunning folks of MH

    Hi

We have just got back from florida and a meeting with Maesbury homes in their offices.

We have up to date pics of Bahama Bay and lots of new information.

we have pulled out of our purchase on phase 8 , and have started legal proceedings to get a refund on our deposit.

I saw at least 2 B B units in the estate agents identical to the one we were buying for $125,000 and $145,000 respectively.

The estate agent was British and she gave me lots of information on valuations etc etc

Please contact me if you want more info

I believe IAP...Global!!?  are asking for more money .. speak to us first pleeeese!!!! dont give them another penny

    Dear Mr or Mrs Cook

Thanks for posting this and offering further info. What was your IAP contract price for your unit which was identical to the $125 and $145 units you saw for sale?

Having all those estate agent valuations now, how much less than the contract price do you think your apartment is worth - 50%? (Less or more?)

Which law firm have you engaged and why that particular firm?

    Hi There,

Can anyone say what income and occupancy rates they are getting from Bahama Bay? Are you getting any income at all?  I was looking at buying a re-sale there.

    Thanks
