im owed money!!!

    im owed money!!!

    hi all, not sure if iv come to the right place but someone might be able to help?-

    im a self employed joiner, and very new to all this, but a contractor owes me 3 weeks wages, iv called him as he lives about 3 hours away from me, and he says 'the cheque is in the post', it should have arrived yesterday but didnt, he owes money to some other lads on site, obiviosly iv pulled off site until im paid, how can i get my money??? i might call him and tell him to send another cheque, or iv been told i can go to the court house and pay £70n to wind up his buisness till i get paid is this a good idea?, all i want is my money- im only young and got alot to learn about buisness but i would appreciate some advice many thanks dave

    ring up him  every day - make a nuisance of your self for the next week or so, so that he knows you mean business.   this is one of the risks of being self employed.    maybe  you could ask for staged-payments on the next contract ?

    thanks clottie il do just that, i did think about going on to site and taking down the work i did just to get my own back, but think it might be illegal not sure

    Hi Dave222,

    Its not nice when people try to pull a fast one on you is it? I have had something similar happen to me in the past. I think Clotties advice of calling him up every day is good is so much as you are trying to brow beat him into paying you etc.

     

    If this does not work however and you really want to recover your money then you may have to go down the Small Claims Court route. The process is really simple and can be done online too. The mention of the Winding Up Order would also be an option if the company is Limited but if the guy is a sole trader then the Small Claims option may be more suitable.

    Hi Dave,

     I'm owed money and got some great free advice from the Citizen's Advice Bureau. Contact them and they will arrange an appointment for you to speak to someone who can advise you.

    If you go here:

     You can take him to court by filling in a simple online form and paying a minimum of £25 depending on how much he owes.

    He will then recieve a summons, which he can reply to in the form of payment, or he can ignore it. If he ignores it then he is given a CCJ. Then you can send the bailiffs round if you wish at an extra cost.

    hi dave, i am self employed too, luckily i have never had this problem(might be coz i'm a seventeen stone skinhead), if the job is still ongoing i would pay a visit to the site and have a word with the lads in the site cabin/ brew room. also if he is the main contractor you could always contact his employer.you could also mention him to inland revenue vat man etc! if all this fails the small claims court is the best way, like the others have said. i hope you get your money!

    (gun grade expanding foam about £8.00 a tin. makes a blindingly good job at getting revenge!)

    It certainly does. A neighbour of mine is so fussy. He always wants a Rolls Royce job but for a Mini Minor price, and always gets the cheapest contractor to do the job. He's retired and stands there watching every move they make from start to finish. One day one of the contractors asked me to move my car as he was expecting a materials lorry to arrive. He said that while he was on his back under the sink fixing the new tap pipes the owner was bent over trying to see what was going on. The chap quipped to the owner "Can you see all right?" The owner said no, and the contractor suggested he get a torch. The owner said it was a good idea, but could he use his as he didn't want to waste his own batteries.

    Anyway, end of job, owner not happy and deducted £50 off the bill (which I think was too cheap anyway). Some days later as I was getting ready to leave for the day I heard shouting in the street. I went outside and saw this chap's Skoda estate full of expanding foam. And I mean FULL. Not sure if more than one can had been used, but not only could non of the doors be opened, the boot area was full as well. The car was scrapped.

    The contractor was interviewed by the police, but had an alibi as he was away to the seaside with his family for the weekend. He is part of a large extended family though, and I bet one of his brothers sorted out the fussy owner on his behalf.

    There's nothing you can do to get this foam off any sort of fabric - car seats, carpets or whatever.
